Terms and Conditions

In the following terms & conditions “the photographer” shall mean Grand Luminous Photography Studio. “The client(s)” shall be those persons defined in the booking form. It is mutually agreed that the following terms of agreement form an integral part of this contract and cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing. By booking with the photographer you agree to the below Terms and Conditions.


1. Booking Fee:

1.1 A non refundable 20% deposit booking free (“Booking Fee”) is required at the time of booking in order to reserve and secure the appointment unless otherwise confirmed by Grand Luminous Photography Studio. Payment may be paid by cash, cheque or bank transfer.


2. Payments:

2.1 Balances owed for photo shoot appointments must be paid in full before the session commences.

Payment for all extra items ordered must be made at the time of ordering. Prices for prints, digital images, mounts and framing options are available upon request. If paying the full balance owed or additional products by cheque prints and products will not be made available until the cheque has cleared!


3. Prices:

3.1 All charges and additional goods specified on the booking form are supplied at the prices ruling on the date of booking. Goods not specified on the booking form are supplied at the prices ruling at the time of receipt of the order.


4. Display:

4.1 The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums etc.


5. License, Coverage and Reproduction:

5.1 Photographs taken during the course of the session/event will be at the discretion of the photographer although every effort will be made to comply with the clients requirements.


5.2 The photographer shall be granted artistic license in relation to the poses photographed and the locations used. The photographer’s judgement regarding these matters shall be deemed correct.


5.3 When attending events the photographer shall endeavour to photograph all individuals as requested by the client(s) at some point, but no responsibility will be taken by the photographer on the occasion of leaving somebody out.


5.4 At certain venues, the photographer’s movements are sometimes restricted by the official in charge. The area from which the photographer is able to cover the event may not be the photographer’s choice and the photographer cannot accept responsibility for any obstructed view should this be the case.


5.5 On location or events due to a variety of uncontrolled lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs.


5.6 Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.


6. Prints, reprints and enlargements.

6.1 The photographer offers a vast array of print and enlargements sizes all with different aspect ratio’s, all of the photographer images are shoot to the aspect ratio of 2:3 which is ideal for most popular enlargement options. However on some of the enlargements sizes, image cropping may/will occur. Please ask advice before ordering enlargements.


6.2 The photographer shall not be responsible for the quality of the prints, reprints and enlargements.


7. Postage & Packaging:

7.1 The post & packing charges (if any) shall be bored by the client(s). 


8. Creative Licence:

8.1 The photographer shall be granted creative and artistic licence in relation to the choice of locations and poses used. The photographer’s judgement on photographic style and the number of photographs taken shall be deemed correct. Some photographs may not be possible due to changes of the weather and the availability and willingness of subjects. The photographer will do his best to honour requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.


9. Copyright:

9.1 The photographer owns the copyright on each and every photographs taken unless at the time of booking a release is negotiated. By purchasing images in either print or digitally the client(s) are purchasing the right to the image, not the copyright and therefore have no rights to reproduce the image in or on any medium. The client(s) may not copy the photographs taken under this contact, or allow copies to be made photographically, electronically, or by any other means. This is a standard condition for professional photographers.


10. Ownership:

10.1 All digital negatives (computer files) remain the property of the photographer. On occasion, the photographer may supply a copy of the edited digital negatives to the client(s) for their own non-commercial use.

This Privacy Notice describes the collection, use and processing of your personal data by Grand Luminous Photography Studio (“Grand Luminous”) in relation to business and commercial transactions relating to the products and services of Grand Luminous and such other matters related to the business of Grand Luminous (hereafter “the Purposes”).

Collection of Personal Data and Existing Personal Data

Personal data means information provided by you which is capable of identifying you, directly or indirectly, and include but are not limited to the following:                                   

  1. your personal particulars such as your name, NRIC number and all details contained in NRIC, address (residential, office and email), contact details (telephone, fax numbers and email addresses), race, gender, nationality and photographs/images

  2. particulars of immediate family members

  3. billing information, financial information, banking and credit card information

  4. personal data collected automatically which include Internet protocol address (IP address), Internet cookies, type of language used, access time and such other personal data relevant when you access Grand Luminous website


Use of Personal Data

Grand Luminous uses the personal data collected for the Purposes which include but are not limited to the following:

  • To complete and/or process business and/or commercial transactions

  • For verification of your identity;

  • To communicate with you;

  • To update our records;

  • To process or assist you in any enquiry on Grand Luminous services and other related matters or business;

  • To provide general information about Grand Luminous services and business;

  • To provide you with the services of Grand Luminous;

  • To improve and develop the products and services provided;

  • Any other relevant purposes directly related to the above Purposes;

  • To comply with any obligations under the law.


Disclosure of Personal Data

Personal data collected in relation to the Purposes may be and/or have been disclosed to but are not limited to the following third parties stated herein. We will notify you if we disclose or have disclosed the personal data to a third party other than those stated herein.

  • Professional advisers and financial institutions engaged by Grand Luminous who are under a duty of confidentiality to Grand Luminous;

  • Relevant local and government authorities for the purposes of assisting in investigations, prevention or detection of crime, and apprehension or prosecution of offenders or to any other party where Grand Luminous is required by law or a court order to do so

  • Third party sub-contractors and service providers appointed by Grand Luminous who are under a duty of confidentiality to Grand Luminous


Right of Access to you personal data

Subject to any exception under applicable laws and pursuant to the Personal Data Protection Act 2010, you may at any time hereafter request for access to or correction of your personal data, or seek further information from Grand Luminous by submitting a written request addressed to Grand Luminous with the following contact details:

If your personal data is inaccurate, or if you need to update or verify your personal data, please contact Grand Luminous at the contact information mentioned above. Please include your name, address, ID Number, and/or email address when you contact Grand Luminous.


Obligatory to Provide Personal Data

It is obligatory to provide the personal data requested by Grand Luminous for the Purposes. In relation to personal data that you have previously furnished to Grand Luminous the retention and processing of such data by Grand Luminous is necessary for the Purposes. If you do not wish to provide the personal data requested, Grand Luminous will not be able to complete business transactions with you or attend to your queries regarding the services of Grand Luminous and related matters.


If you would like to limit any aspect of the processing of your personal data, please submit a written request to Grand Luminous for its consideration. Grand Luminous has the discretion not to allow the limitation of processing where to do so would impair the carrying out of any of the Purposes stated.


If you have furnished any personal data of a third party such as your family members, please ensure that you have obtained their consent for the Purposes as stated in this Privacy Notice.


11. Force Majeure:

11.1 In the unlikely event of total photographic failure, injury or sickness beyond the photographer’s control, their liability shall be limited to a full refund of all monies paid.


12. Cancellation:

12.1 If Grand Luminous Photography Studio has to cancel the appointment for reasons beyond their control (death, injury, sickness, etc.), their liability shall be limited to a full refund of all monies paid. If the client(s) cancels the appointment an unconditional refund policy exists up until 7 days prior to the reserved slot at which point the full Booking Fee will be forfeited by Grand Luminous Photography Studio.


13. Postponement:

13.1 Should the cancelled appointment turn out to be a postponement, then, subject to Grand Luminous Photography Studio’s availability, all monies paid may be applied to the new appointment. In this case, the total fees chargeable shall be the fee which applies at that time. In the event that Grand Luminous Photography Studio take another appointment for your cancelled or postponed date, a full unconditional refund of your deposit and monies paid shall be made. If, following cancellation by the client, a new date cannot be agreed by both parties, the full Booking Fee will be forfeited by Grand Luminous Photography Studio.


14. Postponement Due To Adverse Weather:

14.1 If the appointment has to be cancelled by Grand Luminous Photography Studio due to adverse weather conditions a new, mutually agreed appointment will be made. However, if the client(s) would like a Booking Fee refund, this will be granted.


15. Personal Accident:

15.1 Any directions issued to clients, their guests or employees during a photographic shoot/event are deemed to be at said persons’ own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.


16. Complaints Procedure:

16.1 Please address any complaints to Grand Luminous Photography Studio by email or writing as per our contact details. I will endeavour to respond to any complaint within 7 working days of receipt.
